Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the PodiumEDI platform (“Platform”), operated by Pit² Technology Pty Ltd (“Operator”, “we”, “us”, “our”). By creating an account, ticking the acceptance checkbox during registration, or continuing to use the Platform, you (“User”, “you”, “your”) agree to be bound by these Terms in their entirety.
1. Definitions
- “Platform” means the PodiumEDI web application, including all modules, features, APIs, documentation, and associated software.
- “Operator” means Pit² Technology Pty Ltd, the entity that owns and operates the Platform.
- “User” means any individual who creates an account on or accesses the Platform.
- “Account” means a registered user profile on the Platform, identified by a unique username and protected by a password.
- “Telemetry Data” means motorcycle performance data captured by on-bike data loggers, including but not limited to suspension travel, wheel speed, acceleration, pitch, lean angle, and throttle position.
- “GPS Data” means geographic positioning data including latitude, longitude, speed, heading, and altitude derived from GPS or GNSS receivers.
- “Session” means a single recorded data file (typically a .DAT file) from an on-bike data logger representing one track outing or run.
- “Content” means any information, data, text, notes, contributions, chat messages, or other materials uploaded to or created within the Platform by a User.
2. Acceptance of Terms
By ticking the “I agree to the Terms of Use” checkbox during registration and submitting your account request, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not create an account or use the Platform.
3. Eligibility
- You must be at least 18 years of age to use the Platform.
- The Platform is designed for professional motorcycle racing telemetry analysis. You represent that your use is for legitimate professional, educational, or personal racing analysis purposes.
- If you are registering on behalf of an organisation, team, or other entity, you represent that you have the authority to bind that entity to these Terms.
4. Account Registration and Security
- You must provide a valid email address during registration. Your account will not be activated until your email is verified and an administrator has reviewed your registration.
- You are solely responsible for maintaining the confidentiality of your login credentials.
- You must not share your account with any other person or allow others to access the Platform using your credentials.
- You must notify the Operator immediately if you suspect any unauthorised use of your account.
- The Operator is not liable for any loss or damage arising from your failure to maintain account security.
5. Permitted Use
The Platform is provided for the purpose of motorcycle racing telemetry analysis, including but not limited to:
- Uploading and analysing telemetry session data from supported data loggers.
- Configuring and managing motorcycle setup profiles.
- Viewing GPS track data, video overlays, and statistical analysis.
- Generating and exporting analysis reports.
- Using AI-assisted interpretation features for advisory insights.
6. Prohibited Conduct
You must not:
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Platform.
- Copy, reproduce, redistribute, or create derivative works from any part of the Platform’s software, design, or documentation.
- Scrape, crawl, or use automated tools to extract data from the Platform.
- Upload malicious software, viruses, or any content designed to disrupt the Platform.
- Attempt to gain unauthorised access to any part of the Platform, other user accounts, or the underlying infrastructure.
- Use the Platform for any unlawful purpose or in violation of any applicable law or regulation.
- Circumvent, disable, or interfere with any security features of the Platform.
- Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
7. Intellectual Property
- “Pit²” is a registered trademark of Pit² Technology Pty Ltd. All rights reserved.
- The Platform, including all software code, user interface design, graphics, logos, icons, documentation, and branding, is the exclusive property of the Operator and is protected by copyright, trademark, and other intellectual property laws.
- Nothing in these Terms grants you any right, title, or interest in the Platform’s intellectual property beyond the limited right to use the Platform in accordance with these Terms.
- You retain full ownership of your Telemetry Data and GPS Data. The Operator claims no ownership over data you upload.
8. User-Generated Content
By submitting notes, help contributions, chat messages, or other Content to the Platform, you grant the Operator a non-exclusive, royalty-free, worldwide licence to use, store, display, and incorporate that Content for the purpose of operating, improving, and maintaining the Platform. This licence survives account deletion but the Operator will anonymise Content from deleted accounts.
9. Data Ownership and Portability
- You own your Telemetry Data, GPS Data, and session files. The Operator stores them on your behalf and does not claim any ownership.
- You may request an export of all your data at any time by contacting the administrator or using in-platform export features.
- Upon account deletion, your data is retained for a period of 3 months (as described in the Privacy Policy) and then permanently purged.
10. Service Availability and Best Efforts
- The Platform is provided on a “best efforts” basis. The Operator does not guarantee uninterrupted, error-free, or continuously available service.
- The Operator may perform maintenance, updates, or modifications to the Platform at any time, which may result in temporary service interruptions.
- The Operator is not liable for any data loss, service interruption, or degraded performance caused by hardware failure, software defects, network outage, power failure, natural disaster, act of God, or any other event beyond reasonable control (force majeure).
- No service-level agreement (SLA) or uptime guarantee is provided unless separately agreed in writing.
11. Security
- The Platform is hosted on locally-managed servers (not public cloud infrastructure).
- The infrastructure is protected by firewalls, virtual private networks (VPN), and access controls.
- Data in transit is encrypted using industry-standard TLS protocols.
- Passwords are hashed using industry-standard one-way hashing algorithms and are never stored in plaintext.
- Security is provided on a best-efforts basis. No computer system is completely immune to attack or failure. The Operator cannot and does not guarantee absolute security of your data.
- The Operator will take reasonable steps to protect your data but accepts no liability for breaches, intrusions, or data loss caused by sophisticated attacks, zero-day vulnerabilities, or events beyond reasonable technical control.
12. Limitation of Liability
- To the maximum extent permitted by applicable law, the Operator’s total aggregate liability to you for all claims arising out of or relating to these Terms or the Platform shall not exceed the amount you have paid to the Operator in the 12 months preceding the claim, or AUD $100, whichever is greater.
- In no event shall the Operator be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, loss of data, loss of business opportunity, damage to reputation, or personal injury, regardless of the cause of action or theory of liability.
- The Platform is not a substitute for professional engineering analysis, safety certification, or mechanical inspection. All telemetry analysis outputs, AI-generated interpretations, and setup recommendations are advisory only. You are solely responsible for any decisions made based on Platform outputs.
- The Operator provides no warranty, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
13. Indemnification
You agree to indemnify, defend, and hold harmless the Operator, its directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use of the Platform.
- Your violation of these Terms.
- Your violation of any applicable law or regulation.
- Any Content you submit to the Platform.
- Any decision you make based on Platform outputs, analysis, or recommendations.
14. Termination
- The Operator may suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms, suspected fraud, or inactivity.
- You may request account deletion at any time through your Profile page or by contacting the administrator.
- Upon account deletion, your data is retained for 3 months (see Privacy Policy) and then permanently purged.
- Sections that by their nature should survive termination (including Intellectual Property, Limitation of Liability, Indemnification, and Governing Law) shall survive.
15. Modification of Terms
- The Operator reserves the right to modify these Terms at any time.
- If material changes are made, you will be notified by email (if you have opted in to notifications) and prompted to re-accept the Terms on your next login.
- Continued use of the Platform after notification of changes constitutes acceptance of the revised Terms.
- If you do not agree to revised Terms, you may request account deletion.
16. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Operator regarding your use of the Platform and supersede all prior agreements, representations, and understandings.
18. Waiver
The failure of the Operator to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
19. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Western Australia, Australia. You agree to submit to the exclusive jurisdiction of the courts of Western Australia, the Federal Court of Australia sitting in Western Australia, and courts of appeal therefrom.
